1. Overview

eaurougejewelry.com (the "Site") is the online store of Eau Rouge. Eau Rouge is operated by Kaanpasa LLC ("Eau Rouge", "we", "us" or "our"). Throughout the Site, "you" means the person visiting the Site or buying from us.

By visiting the Site or placing an order, you agree to these Terms of Service ("Terms"), together with our Terms of Sale, Privacy Policy, Cookie Policy, Shipping Policy and Return and Refund Policy, which are part of these Terms. Orders are governed by the Terms of Sale; if these Terms and the Terms of Sale differ on an order matter, the Terms of Sale control. If you do not agree, please do not use the Site.

2. Who may order

You must be old enough to enter into a binding contract where you live and be at least 18 years old. You agree to provide accurate and current information when you order or create an account.

3. Products and descriptions

We make every effort to describe and photograph our jewelry accurately. Gold karat (8K, 10K, 14K or 18K) and gold color are stated for each option you select. Because jewelry is made to order and photographed under different lighting, colors, sizes and finishes may vary slightly from the images or from your screen. Stone color and natural variation in gemstones and pearls are normal.

We may change product descriptions, options and availability at any time. We may limit the quantity of any item you can order.

4. Made-to-order and personalized orders

Every piece is made to order after you place your order. Production and dispatch typically take 5–8 business days, as described in our Shipping Policy. Personalized pieces may need additional time if we need to confirm details with you.

When you personalize a piece (for example with names, initials, birthstones, birth months or fonts), you are responsible for checking that every detail you enter is correct, including spelling, spacing and capitalization. We make personalized pieces from the details you submit. This does not limit your remedies if we make an error or do not follow the details you submitted. Personalized and custom-made items are non-returnable and non-refundable except as stated in our Return and Refund Policy or required by applicable law.

5. Prices and availability

All prices are in U.S. dollars. Prices and offers may change without notice. If an obvious pricing or listing error affects an order, we may cancel the order and refund you in full, to the extent permitted by applicable law. Sales tax is calculated at checkout based on your delivery address and added to the order total.

6. Orders and acceptance

Placing an order is an offer to buy. We accept your order when we send you an order confirmation email. We may decline or cancel an order, for example because of a product or pricing error, suspected fraud, or information we cannot verify. If we cancel an order after payment, we refund the amount charged.

7. Payment

Payment is processed at checkout through our payment providers and the payment methods shown there. By placing an order you confirm that you are authorized to use the payment method. You agree to provide current, complete and accurate payment and billing information. Payment details are entered at Shopify's secure checkout and processed by our payment provider; we do not receive or store full payment card numbers on our Site.

8. Shipping and delivery

We currently ship only to addresses in the United States. Shipping options, production time, estimated carrier transit times and order tracking are described in our Shipping Policy. Production time (5–8 business days) is separate from carrier transit time, which is estimated at 3–5 business days for Standard and 2–3 business days for Express after dispatch. All delivery timelines are estimates, not guaranteed delivery dates, and carrier delays can occur. Nothing in these Terms affects any rights you have under applicable law if an order is lost or damaged in transit.

9. Cancellations, returns and refunds

To ask about changing or cancelling an order, email sales@kaanpasa.com as soon as possible with your order number. Because every piece is made to order, we cannot guarantee that a change or cancellation will be possible once production has begun.

Returns and refunds are governed by our Return and Refund Policy. In summary, eligible standard, non-personalized items may be returned within 30 days of delivery in unused and original condition after we approve the return; a flat return shipping fee applies to voluntary returns; gift cards and final-sale items cannot be returned; and personalized and custom-made items are non-returnable and non-refundable except where the policy or applicable law says otherwise, including for items that are defective, damaged or incorrect. The Return and Refund Policy controls if it differs from this summary.

10. Care and wear

Gold is a precious but not indestructible metal and can scratch, dent or wear with time. Please follow the guidance on our Jewelry Care page. Normal wear and damage caused by misuse, chemicals or accidents are not product defects.

11. Warranty and your legal rights

We do not offer an additional express warranty. Nothing in these Terms limits any rights you have under applicable law, including your rights if an item is defective, damaged or incorrect, as described in our Return and Refund Policy.

12. Intellectual property

The Site and its content, including text, photographs, graphics, logos, product designs and the Eau Rouge name, belong to Kaanpasa LLC or its licensors and are protected by law. You may not copy, reproduce, sell or use them for commercial purposes without our written permission.

13. Product reviews

Product reviews are collected and displayed through our review provider, Judge.me, and are subject to Judge.me's terms. You keep ownership of the review you submit. We display reviews on the Site as provided through Judge.me, and we do not change a reviewer's star rating.

14. Acceptable use

You agree not to misuse the Site: for example, by attempting to gain unauthorized access, interfering with its operation, introducing malicious code, scraping it in violation of applicable law or our instructions, or using it for any unlawful purpose.

15. Third-party services

The Site is powered by Shopify and may link to or integrate third-party services (for example payment, shipping and review providers). We are not responsible for third-party websites or services, and your use of them is subject to their own terms.

16. Privacy

Our Privacy Policy explains how we collect and use personal information. By using the Site you acknowledge that policy.

17. Changes to these Terms

We may update these Terms from time to time. The version posted on the Site with its "Last updated" date applies to orders placed after that date.

18. Severability

If any part of these Terms is found unenforceable, the rest remains in effect.
